Terms of ServicesThe Terms of Service (hereinafter referred to as the “TS” or “TS Agreement”) is a legal agreement between FDrive Inc. (including its subsidiaries and related companies) and individuals (hereinafter referred to as “Users”) outlining the rules, requirements, restrictions, and limitations that users must abide by to use FDrive Inc. products. It also defines the terms of FDrive Inc. 's services and functions used by the Users.FDrive Inc. is a legal entity incorporated under the Ras Al Khaimah Digital Assets Oasis Companies Regulations 2023. It owns actual rights on the Application, including but not limited to intellectual and legal rights.FDrive Inc. is located at Office A, RAC BANK ROC Office ground floor, RAK DAO Business Center, Sheikh Mohammed Bin Zayed Road, Al Raffa, Ras Al Khaimah, UAE.General Terms:● By accessing any FDrive Inc. product, the User accepts this legal agreement.● In addition to this TS, the relationship between the User and FDrive Inc. includes allspecial documents governing the provision of specific services and functions offered by FDrive Inc. and made publicly available.By accepting the TS, the User acknowledges and agrees that their data will be received, processed, and stored as outlined in the Privacy Policy. The User's personal data will be received, processed, stored, and disclosed in accordance with applicable legislation to provide the User with existing and new Application services.To protect User data and comply with the UAE Federal Decree Law No. 45 of 2021 on the Protection of Personal Data, FDrive Inc. is committed to maintaining data confidentiality and individual privacy. The law governs the processing of personal data, whether in whole or in part, electronically or otherwise, domestically or internationally. FDrive Inc. adheres to User rights under this law and other applicable data protection regulations.Intellectual property, including but not limited to patents, trade secrets, copyrights, and know-how, is governed by the UAE Federal Decree-Law No. (38) of 2021 on Copyright and Neighboring Rights, the UAE Federal Law No. (11) of 2021 on the Regulation and Protection of Industrial Property Rights, the Federal Decree-Law No. (36) of 2021 on Trademarks, and other relevant intellectual property laws.Appeals, suggestions, and complaints regarding this TS Agreement, FDrive Inc. products operation, or potential violations of third-party rights and interests while using the products, from both individuals and legal entities, can be directed to etis.revirdoof%40nosnhojaniracBy accessing FDrive Inc. products and services, the User confirms that they meet the minimum age required by the laws of their country to do so. If the User is below the minimum age required to consent to this TS Agreement, their parent or legal guardian must agree to the terms on their behalf. If a parent or legal guardian permits a child (who meets the minimum age requirements) to use FDrive Inc. products and services, this TS also applies tothe parent or legal guardian, who is responsible for the child's activities on the services, including any purchases made.To access FDrive Inc. products and services continuously, the User must create a FooDriver account by providing a username, password, contact information (such as email address and/or phone number), and birthdate. Additional verification or information may be required. The User is responsible for providing accurate information and maintaining its accuracy within the FooDriver account. FDrive Inc. assumes that all communications from or purchases made through a FooDriver account are authorized by the registered User.The User is responsible for safeguarding their account and must notify FDrive Inc. immediately of any unauthorized access. Using a unique password for the FooDriver account is strongly recommended.The User may not license, sell, lend, or transfer their FooDriver account, username, vanity URL, or other unique identifier without FDrive Inc.'s prior written consent. FDrive Inc. retains the right to delete, modify, or reclaim any FooDriver username, URL, or identifier.The User agrees not to engage in any activities that violate applicable laws, international regulations, intellectual property rights, copyrights, related rights, or generally accepted moral and ethical standards. The User further agrees not to perform any actions that could or do impair the functionality of FDrive Inc.'s products and services.Software:FDrive Inc. may offer client software for download. FDrive Inc. grants the User a worldwide, non-exclusive, personal, and non-transferable license to download, install, and use this software solely for accessing FDrive Inc. services, provided the User complies with this TS Agreement.The User may not copy, modify, create derivative works, distribute, sell, lease, sublicense, reverse engineer, decompile, or disassemble FDrive Inc.'s software or services, nor may the User assist others in doing so, unless expressly permitted by applicable law. All intellectual property rights in the software and services belong to FDrive Inc.FDrive Inc. software may provide access to third-party apps, bots, or other services (collectively, "Third-Party Services"). The User's decision to use Third-Party Services and participate in servers incorporating them is entirely voluntary. Before using Third-Party Services, the User should carefully review their respective terms, conditions, and policies, as these govern their use.FDrive Inc. is not responsible for any external resources accessed through links within the software, including any purchases made through third-party services.The User acknowledges that the software and its components may contain advertising. FDrive Inc. assumes no responsibility or liability for such advertising.The User is solely responsible for all activities conducted using their mobile phone number, social media account, email address, username, and password. The User's chosen login credentials (phone number, email address, and password) are required for accessing their personal account. The User must safeguard their password and avoid sharing it with others.FDrive Inc. reserves the right to perform preventive maintenance, which may temporarily suspend software operation with or without prior notice.Paid Services and FooDriver Tokens:FDrive Inc. products and services may include fully or partially paid services, such as premium subscriptions, virtual goods, limited features, and other offerings.FDrive Inc.'s FooDriver platform utilizes third-party payment processors. By providing payment information, the User confirms: (i) authorization to use the specified payment method; (ii) agreement to pay for paid services by the due date; (iii) accuracy of payment information; (iv) FDrive Inc.'s right to retain payment information as submitted by the User and payment network; and (v) FDrive Inc.'s authority to charge the User for paid services using the provided payment method, including any applicable taxes.The User authorizes FDrive Inc. to retain and share purchase and payment information with financial institutions and payment processors (including future ones) for transaction processing. The User consents to FDrive Inc. using the provided contact information to send notices regarding renewals, recurring charges, and purchase-related changes.Users may be required to agree to additional terms and conditions before accessing paid products or services. Users under the age of 18 (or the legal age of majority in their jurisdiction) must obtain parental or guardian consent for FooDriver purchases (refer to the User's Account and Responsibilities section).FDrive Inc. is not responsible for any fees or charges imposed by financial institutions or payment processors. In certain cases, payment by invoice may be allowed. Invoices will be sent to the User's FooDriver account email address within forty-five (45) days of purchase. All invoices are due within thirty (30) days of the invoice date, unless otherwise stated. Payment is in US dollars unless specified differently.FooDriver Tokens (FDC Tokens) are ERC-20 standard tokens used for payments within the FDrive Inc. FooDriver Application.FDC Points are in-game currency exclusive to the FooDriver game application. FDC Points and FDC Tokens are separate currencies and cannot be converted.DISCLAIMERTO THE MAXIMUM EXTENT PERMITTED BY LAW, FDRIVE INC., ITS AFFILIATES, AND THEIR RESPECTIVE SUPPLIERS MAKE NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE SERVICES. THE SERVICES ARE PROVIDED “AS IS.” FDRIVE INC. DISCLAIMS ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, QUIET ENJOYMENT, AND NON-INFRINGEMENT. ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE ARE ALSO DISCLAIMED. IF APPLICABLE LAW DOES NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SUCH WARRANTIES ARE LIMITED IN DURATION AND REMEDY TO THE MAXIMUM EXTENT PERMITTED BY LAW.MiscellaneousThis TS Agreement does not establish an agency, partnership, joint venture, employment, or any other relationship between the User and FDrive Inc. beyond the terms explicitly outlined herein.Severability: If any provision of this TS Agreement is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.Waiver: FDrive Inc.'s failure to enforce any provision of this TS Agreement does not constitute a waiver of its rights to do so in the future.Third-Party Offers: FDrive Inc. is not liable for cancellations or modifications to offers or events provided by third parties.User Eligibility: The User is an individual who meets the required age and has the legal capacity to agree to these terms.User Information: The User is responsible for ensuring the accuracy, completeness, and timeliness of the information provided during registration, and that it is free from any third-party claims.Reporting Violations: To report a violation of this TS Agreement, Users can contact .etis.revirdoof%40nosnhojanirac
